Legislative Decree no. 42 of January 22, 2004 regulates the export of Cultural Property outside the territory of the Italian Republic.
EEC Regulation no. 3911/92 of December 9, 1992, as amended by EEC Regulation no. 2469/96 of December 16, 1996, and EEC Regulation no. 974/01 of May 14, 2001, regulates the export of Cultural Property outside the European Union.
To export Cultural Property over 50 years old from Italy, an Export License is required, which the buyer must obtain personally.
The auction house is not responsible for such permits and cannot guarantee their issuance. Upon request, the auction house may handle the application process for the export licenses; related costs are borne by the buyer.
Failure to obtain these authorizations does not justify the cancellation of the purchase or non-payment.
According to Article 8, paragraph 1, letter B of Presidential Decree 633/72, buyers wishing to export the item outside the EU and obtain a VAT refund must comply with the following procedures:
Complete customs procedures and export the item outside EU territory within 3 months from the invoice date
Submit the original customs declaration or an equivalent document within the same 3-month period, directly to the auction house
The 3-month deadline, starting from the invoice date, may be suspended for the time required to obtain the export certificate.
